TERMS OF SALES

Clause n° 1 : Object

The general conditions of sale described below detail the rights and obligations of “the company Christian Foucaud (ph modular)” and his client in connection with the sale of all goods presented on the “shop“.
For a better comprehension, the title “Christian Foucaud (ph modular)” is replaced by “ph modular” below.
Any service performed by “ph modular” implies the unreserved acceptance of the buyer to these terms and conditions.
 

Clause n° 2 : Price

The prices of the goods sold are those in force on the day of ordering. They are denominated in euros and calculated net the company Christian Foucaud (ph modular) being exonerated of the VAT, according to French “article 293-B du CGI”). As a result, they will be increased by the shipping costs applicable on the day of the order.
“ph modular” grants the right to modify its rates at any time. However, he undertakes to invoice the goods ordered at the prices indicated when the order is registered.
 

Clause n° 3 : Discounts or rebates

The proposed rates include discounts and rebates that “ph modular” would be granted under conditions.

Clause n° 4 : Discount

No discount will be granted in case of advance payment.

Clause n° 5 : Terms of payment

The payment of the orders is carried out:

  • either by paypal;
  • by bank transfer

When registering the order, the buyer will have to pay the total amount of the invoice, which will trigger the sending of (the) merchandise(s). The goods being sometimes manufactured on demand, a delay (specified during the order and before the settlement phase) may be necessary.

Clause n° 6 : Retention of title clause

“ph modular” retains ownership of the goods sold until full payment of the price, in principal and accessories. As such, if the buyer is the subject of a reorganization or a liquidation judicial, “ph modular” reserves the right to claim, in the context of the collective procedure, goods sold and remained unpaid.

Clause n° 7 : Delivery

Delivery is made at the place indicated by the buyer during the payment phase. Refer to the pricing conditions below.

The service provider generally used is “La Poste” (or providers depending on the country), with tracking number*. If you want another way of delivery, do not hesitate to contact me. The rates offered by “ph modular” include packaging and shipping.

Warning! “La Poste” or the post office of the country of destination may request the collection of customs clearance fees and customs duties and local taxes.

SHIPPING COSTS

Delivery costs are calculated according to the weight of the package (module(s), accessory(ies), packaging and wedging included). They take into account packaging, handling and shipping costs.

The tracking stop at the French border for other destinations

The delivery time indicated during the registration of the order is given for information only and is not guaranteed.

Consequently, any reasonable delay in the delivery of the products can not give rise to the benefit of the buyer to:

  • the award of damages and interest;
  • the cancellation of the order.

The risk of transport is borne entirely by the buyer.
In case of missing or damaged goods during the transport, the buyer will have to formulate all the necessary reserves on the purchase order upon receipt of said goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter with accused reception.

Clause n° 8 : Force majeure

The responsibility of “ph modular” can not be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale arises from a case of force majeure. As such, force majeure means any external event, unforeseeable and irresistible within the meaning of article 1148 of the French Civil Code.

Clause n° 9 : Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

In the absence of amicable resolution, the dispute will be brought before the Commercial Court of Vannes (19 rue des Tribunaux, 56000 VANNES – FRANCE).
